Understanding Workers' Compensation Benefits

In general, there are two types of workers' compensation benefits:

  • Medical
  • Indemnity

Medical benefits are designed to cover your medical treatment and expenses. There is no co-pay and no deductible for treatment received — the insurer pays for everything. The treatment received must be reasonable, necessary, related to the work injury, and designed to bring about a cure.

While these types of benefits do cover much of your medical treatment, they do not cover "feel good" treatments such as therapeutic massage that are often essential in getting you back to 100%.

Indemnity benefits are designed to help cover lost wages incurred as a result of being unable to work. There are three types of indemnity benefits:

  • Temporary total disability: awarded when you are unable to do anything but rest, recuperate, and allow your injury to heal. The amount of benefit is determined by a percentage of your take-home pay.
  • Temporary partial disability: awarded when you are able to work, but unable to make your regular wage because of working fewer hours or doing different tasks. The benefit fills in a portion of the gap between what you are currently earning, and what you were earning before your injury limited your performance.
  • Permanent partial disability: awarded if your injury has healed to its maximum medical improvement, yet you still do not have 100% capability.
